Sometimes, individuals marrying later in life or for a second time seek to use a pre-nuptial agreement, because they have concerns about protecting property they’ve accumulated, large incomes, or they want other family members to receive some of their estate.
Pre-nuptial agreements are enforceable ONLY if there has been a full and complete disclosure of ALL assets and income to the other party; broad statements that the other party “will be taken care of” are completely unenforceable.
