ASSIGNMEMNT OF PARENTAL RIGHTS
Knowing and seeking protection under existing State law is more important today than ever.
New Jersey has a series of statutory provisions (NJSA 3B:12-39 and 74) that allows parents to delegate their parental powers regarding a child or minor ward’s care, custody or property. The authority given by the parent (in the nature of a Guardianship) is a delegation of those parental rights. It can be triggered by specific enumerated events, including, but not limited to, immigration detention, removal or deportation.
In initiating the process, it is extremely important that you have birth certificates for all children and copies of marriage certificates for the parents.
This delegation of authority can only be altered by Federal/State Law or Agencies, or a challenge in a Court of law.
