I’m often asked by clients whether there is a possibility of entering into a plea bargain regarding their traffic charges. The answer to that is yes. Naturally, it’s going to depend upon the nature of the charges and the numbers of them. In almost every circumstance, the police officers or prosecutors are willing to reduce charges. They will look at an individual’s prior record, they’ll look at the severity of the charge, and they’ll look at some type of reasonable basis for a plea. Whatever happened at the time of the traffic stop becomes important because if the individual who was initially charged was courteous and the officer essentially had a respectful response, then the chances of getting charges reduced is very high.
