- Teachers who are non-tenured and non-renewed have some rights.
- Teachers have the right to be notified in advance, and the school has time restrictions on such notification. If the time restrictions are not met, the teacher must be automatically renewed.
- If time parameters are met, teachers have the right to a written explanation of the reasons for non-renewal, and the right to a hearing in front of the school board.
- Beyond that, teachers have the right to court action, to try to convince the court that the district acted “arbitrarily and unreasonably”. This tends to be more difficult, because the teacher must prove their assertion.
- Your best bet is getting competent legal representation at each step of the process.
