An attorney’s role in a real estate transaction is pivotal to a smooth transaction. Initially, the attorney is responsible to negotiate the terms of the agreement of sale with the other attorney so as to keep in mind the best interest of their client as the buyer or the seller. After the agreement is agreed upon by both parties, the attorney is then responsible for drafting the transfer documents. This includes the deed, affidavit of title, mortgage note – things of that nature.
After the agreements are drafted, ultimately the attorney is responsible for representing you at the closing. The closing can often be daunting due to the numerous complexities of the documents needed to be signed. The attorney will provide clarity in explaining certain thing at the closing table.
